Information for Senior Managers

Part 6 of the Public Service Act imposes a number of obligations on senior managers and deputy's heads.  The following is a summary:

  • A deputy head who receives a disclosure of wrongdoing must immediately notify the Deputy Minister responsible for the Public Service Act
  • A Deputy Minister who receives a Second Step disclosure of wrongdoing must immediately notify the Ethics Officer and advise him of the steps being taken with respect to the matters disclosed
  • A deputy head must co-operate fully with the Ethics Officer in an investigation and ensure that all employees of the department or public body also do so
  • A deputy head who receives a disclosure from an employee may notify any Deputy Minister who the deputy's head considers appropriate in the circumstances
  • Every deputy head must encourage the prevention of wrongdoing in the public service
  • Every deputy head must encourage the disclosure of wrongdoing in the public service
  • Every deputy head must inform all employees of the provisions of the Public Service Act relating to the Ethics Officer and the disclosure of wrongdoing and must ensure that every employee is familiar with the procedures for disclosing wrongdoing and the protections from acts of reprisal for doing so
  • A deputy head who fails to cooperate or fails to ensure that his or her employees cooperate in an investigation by the Ethics Officer is guilty of an offence with a fine up to $10,000
